FADP, GDPR and EU AI Act — we think all three together.
The revised Federal Act on Data Protection (FADP) has been in force since September 2023. Contrary to what is often assumed, fines of up to CHF 250'000 can hit the responsible individual, not just the company — and data transfers abroad are regulated more strictly than under the GDPR. The EU AI Act, in turn, does not apply directly in Switzerland but concerns you as soon as your AI outputs arrive in the EU. We make sure both worlds are cleanly covered.

The revised Swiss FADP is modeled on the GDPR but has its own emphases: fines can hit the responsible individual personally, and data transfers abroad are regulated more strictly. We take both into account in implementation.
Does the EU AI Act affect Swiss SMEs?
It does not apply directly in Switzerland but becomes relevant as soon as your AI outputs are used in the EU — for example with customers or partners in the EU area. We check what applies to you and implement accordingly.
